Colorado’s Protection for Public Workers Act (PROPWA) reaffirms that public employees have the rights to:
- Speech related to representation and workplace issues
- Concerted activity for mutual aid and protection
- Political participation off-duty
- Organizing, forming, or joining a union
- Complaining, testifying about, or opposing a violation of PROPWA
PROPWA protects these rights so long as they don’t disrupt the employer’s delivery of public services nor the employee’s duties.
Public employees can’t engage in protected activity while on-duty, but employers are allowed to engage in workplace conversations that discourage union participation.
Public employers MAY NOT:
- Interfere with, deter, or retaliate against protected activity
- This includes an existing rule being enforced only after union activity
- Threaten or deter people from joining the union
- Offer a benefit for not doing protected activity
- Create an impression of surveillance related to protected activity
